Protection orders for the elderly are meant to protect an elderly adult from anyone who may be physically or emotionally abusing them.
There are two types of protection orders you can file:
- Ex Parte, which generally last up to 10 days or until the final judgement is rendered.
- Final order, which commits the ex parte order to permanent status (unless directed otherwise by the judge.)
An ex parte protection order offers the same protections as a general restraining order, which include restricting any form of contact, forcing the abuser away from your home or work, and refraining the abuser from living with the abused. Once the final order is rendered, the judge can help return any property or money under the abuser’s control and help pay for damages.
If you are over the age of 65 and are the victim of neglect, abandonment, or any form of physical, emotional, or sexual abuse, you may be eligible to apply for a protective order.
